Volkswagen will have to pay those who bought from the models involved in the company’s diesel scandal, the German Federal Supreme Court (BGH) ruled on Monday on the claim of a customer.
The lawsuit was filed by a German man who bought a Sharanth in 2014. The court ruled on Monday that if the owner so requests, Volkswagen must repurchase the car, but the mileage traveled by the vehicle must be taken into account when determining the purchase price.
The decision is precedent-setting. The question of whether car owners are entitled to compensation has already been addressed by lower courts, but has made a different decision.
The German car owner who filed the petition originally wanted Volkswagen to repay the full purchase price he paid in 2014 for his car.
