The introduction of tolls in Germany for practically exclusively foreigners is a violation of Community law, said the European Court of Justice in its Tuesday judgment.
The basic idea behind the tolling system adopted in Germany two years ago is that German and foreigners also have to pay tolls, but domestic car drivers are relieved by reducing vehicle taxes.
Austria - with the support of the Netherlands - turned to the European Court of Justice, saying that the rules practically discriminate against foreign drivers, and that they only have to pay for road use.
The judges in Luxembourg gave the plaintiff the right on Tuesday, so the German authorities had to amend or withdraw the challenged legislation.
