BMW will have to pay a tens of millions of euros for discharging the engine control software engine for emissions control in some diesel cars.
The Munich prosecution has been investigating BMW for about half a year.
In February, BMW reported to the Federal Vehicle Inspectorate (Kraftfahrt-Bundesamt) for an irregularity affecting its 750xd and M550xd models.
According to BMW's announcement at the time, the bug in the software was based on "not intentional but inattentive". The affected 7600 car was recalled by BMW for repair.
Both the prosecution and the BMW did not want to comment.
